You hereby acknowledge and agree that participation and use of equipment by
athlete involves risks of injury to persons and property, including those
described below, and Athlete assumes full responsibility for such risks. Athlete
agrees to the following: Athlete hereby releases and holds Wood’s Warrior
Training, its directors, officers, employees, and agents harmless from all liability
to athlete, athlete’s children and athlete’s personnel representatives, assigns,
heirs, and next of kin for any loss or damage , and forever give up any claim or
demands therefore, on account of injury to Athlete’s person or property,
including injury leading to the death of athlete, whether caused by the active or
passive negligence of Wood’s Warrior Training or otherwise, to the fullest
extent permitted by the law, while athlete or athlete’s minor children are
participating in training. Athlete also hereby agrees to indemnify Wood’s
Warrior Training from any loss, liability, damages or cost Wood’s Warrior
Training may incur due to the presence of athlete or athlete’s children in, upon,
or about the training area or in any way observing or whether caused by the
negligence of athlete or otherwise. You represent (a) that athlete and athlete’s
minor children are in good physical condition and have no disability, illness, or
other condition that could prevent athlete(s) from participating in the training
without injury or impairment of health, and (b) that athlete has consulted a
physician concerning a training program that will not risk injury to athlete or
impairment of athlete’s health. Such risk of injury includes ( but is not limited
to): injuries arising from use by athlete or others of equipment and machines;
injuries arising from participation by athlete or others in supervised or
unsupervised activities or programs while with Wood’s Warrior Training :
injuries and medical disorders arising from training at Wood’s Warrior Training
as heart attacks, strokes, heat stress, sprains, broken bones, and torn muscles
and ligaments, among others; and accidental injuries occurring while with
Woods Warrior Training. Athlete further expressly agrees that the foregoing
release, waiver and indemnity agreement is intended to be as broad and
inclusive as is permitted by the law of the State of Texas and that if any portion
thereof is held invalid, it is agreed that the balance shall, notwithstanding,
continue in full forces and effect. Athlete has read this release and waiver of
indemnity clause.
